Terms & Conditions

• The raffle prize is a 2008, 40-foot, Monaco Knight motorhome, model number 40SKQ.

• A ticket represents a chance to win the opportunity to accept an offer of the stated prize on these terms and conditions and, upon winning, those in the “Winner Notification Agreement,” the terms of which are hereby incorporated by reference. Winning tickets shall be selected by a drawing at random and all participants have an equal opportunity to win. Tickets and the winners’ rights are not transferable. Winners need not be present at the drawing.

• The winner agrees to accept the prize in the “as is, where is” condition, with absolutely no express or implied warranties of any kind by Innovations Housing, Inc.

• The winner will be notified in writing in a Winner Notification Agreement, which will be sent by certified, return receipt U.S. Mail to the address provided by that winner at the time that they purchase the ticket. The winner will have fourteen (14) days from the date of his or her receipt of the Winner Notification Agreement to accept the prize by executing and returning the Winner Notification Agreement pursuant to the terms stated therein. Failure to execute Innovations Housing Web Site Content Page 6 of 7 and return the Winner Notification Agreement and accept the prize “as is,” timely, and pursuant to the terms stated in the Winner Notification Agreement, will automatically result in forfeiture of the prize, with no substitution or alternative prize available to the original winner. In the event of forfeiture, a new winner will be selected from the original entries.

• The prize will not be awarded, and will be deemed forfeited, if the winner’s ticket was issued in exchange for a check returned for “insufficient funds” or “account closed”.

• The prize will not be awarded, and will be deemed forfeited, if the winner’s ticket was issued in exchange for a credit card charge deemed “declined”, “invalid”, “stolen” or “in dispute”.

• The prize may not be substituted or exchanged by the winner. Innovations Housing, Inc., may substitute a prize of equal or greater value should a featured prize become unavailable.

• All sales of raffle tickets are final and there shall be no refunds.

• The winner shall have no rights in the prize until the prize is fully and unconditionally accepted by the winner as evidenced by the timely execution and return of the Winner Notification Agreement and until complete delivery of the prize is made to the winner.

• The prize remain the sole property of Innovations Housing, Inc., until unconditionally accepted “as is, where is” by the winner.

• Acceptance of a prize is permission for Innovations Housing, Inc., to use the name, pictures, video images, and relevant quotes of the winner for future fundraising.

• The winner of the prize will be subject to any and all Federal and State income taxes and any other taxes payable due to their acceptance of their prize and the law, regulations, procedures, rules and directives applicable to raffles. All federal, state and local laws relating to the transfer, ownership or use of the prize apply. The prize shall not be transferred until all legal requirements have been met. The winner of the prize agrees that the “fair market value” as determined by a certified public accountant chosen by Innovations Housing, Inc., will be used to determine the value of the prize for income tax and all other purposes.

• If there is more than one name on the ticket, the prize will be awarded to the first name listed on the ticket as the winner, so long as that person is eighteen (18) years of age or older. It is the sole responsibility of the winner in a multiple party entry to allocate any prize among the participants in the multiple party entry.

• Purchase of this ticket constitutes full agreement by the purchaser that he or she agrees with all terms and conditions set forth herein.

• Officers, directors and employees of Innovations Housing, Inc., and their immediate families are not eligible to participate.

• Must be 18 years of age or older to participate and to win the prize.

• Void where prohibited by law.
